Subject: Breaches of Restraining Orders and Non - Molestation Orders
Request and Answer:
Your request for information has now been considered. In respect of Section 1(1)(a) of the Act we can confirm that the Police Service of Northern Ireland does hold information to which your request relates. The decision has been taken to disclose the following.
Question 1
Please may I request a list of which actions (made by/on behalf of Restrained Parties) constitute breaches of Restraining Orders and Non-Molestation Orders.
Question 2
Please may I also request information in relation to which actions fall under direct and indirect breaches respectively.
Answer 1
Police will investigate all reports regarding breaches of court orders. They will look at the conditions of the order that are in place as they will vary in each case.
Answer 2
Police will consider the evidence in each case whether a breach has occurred and act accordingly. A definitive list of actions cannot be provided as the conditions will vary in each case.
